Mr. Bloomstein’s practice is concentrated on the defense of complex medical malpractice matters from the commencement of the lawsuit through trial. He currently represents major hospitals, medical groups and individual physicians in suits venued within New York City, Long Island, Westchester, Rockland and upstate counties.
Defense verdict for a plastic surgeon alleged to have mismanaged nasal and forehead reconstruction surgery following Mohs removal of extensive skin cancers.
Defense verdict for a pediatrician who allegedly failed to diagnose malignant melanoma and who purportedly altered the EMR as part of a "cover-up."
Defense verdict for a vascular surgeon claimed to have misplaced a vena cava filter, which then migrated to the heart, perforated a vessel and led to death.
Discontinuance during trial of internist who allegedly failed to diagnose an astrocytoma/brain tumor.
Summary judgment for a hospital accused of improperly monitoring a patient during spinal surgery.
Directed verdict at the close of plaintiff's case for an orthopedic surgeon accused of unnecessarily performing arthroscopy, thereby leading to significant knee deformity and the need for total knee replacement.
Defense verdict for general surgeon who allegedly damaged the bile duct during gallbladder surgery, thereby requiring subsequent repairs.
Additionally, Mr. Bloomstein was a member of the firm's toxic tort defense team for the World Trade Center 9/11 Debris Removal Litigation pending in the Southern District.
Mr. Bloomstein graduated from Rutgers College and earned his law degree from Pace University School of Law, where he graduated cum laude, served as an editor of the law review and was a moot court finalist. He is admitted to the state courts of New York and New Jersey, as well as to the United States District Courts for the Southern and Eastern Districts of New York and for New Jersey. He has been a partner with the firm since 2002.
Mr. Bloomstein also serves as a trustee of the Half Hollow Hills Community Library.
