ARFD client granted summary judgment in Queens County

Aaronson Rappaport associates Daniel Milstein and Daniel Oresajo successfully moved and argued for summary judgment on behalf of their client, a consulting plastic surgeon, by arguing to limit the duty owed by their client during a vascular surgery that was performed to restore blood flow to the hand of the 78-year old plaintiff, who, ultimately, required an above-the-elbow amputation. Directed verdict in Kings County for Lawrence Rosenblatt and his trial team

Last week, Lawrence Rosenblatt and his trial team were able to successfully argue at the close of plaintiffs’ case for a directed verdict on behalf of a urologist in a wrongful death action. It was claimed the patient, a diabetic, deteriorated and died from the effects of septic shock five days after a prostate biopsy and that the death was as a result of the failure to properly place the patient on antibiotics following the procedure and  a failure to appreciate the significance of the patient’s fever after the biopsy.  After the plaintiffs rested, a motion was made to dismiss.  It

Trial team lead by Daniel Nessim achieves defense verdict in New York County

Aaronson Rappaport celebrates another win for a happy client. Partner, Daniel Nessim, and his trial team received a defense verdict in New York County for their physician client operating an independent gastroenterology practice.  The case involved claims that there was a failure to diagnose celiac disease leading to malabsorption syndrome, overall weakness and nephropathy, requiring the 47 year old plaintiff to use a walker and wheelchair for mobility and need the assistance of a home health aide. In closing, plaintiff asked the jury to aware $10 Million in damages.
