The case involved claims that the defendants failed to properly observe the plaintiff, a middle-aged male plaintiff, who had recently undergone a left rotator cuff repair surgery, during a nuclear stress test, causing him to suffer a new tendon tear to the same shoulder. Bench trial win for ARFD associate, Nanor Terjanian, in New Jersey’s Bergen County Superior Court!

Aaronson Rappaport proudly congratulates associate, Nanor Terjanian, on her successful handling of a New Jersey bench trial on behalf of an ARFD client, a healthcare IT consulting services company, in a breach of contract action against a healthcare IT retailer.   The action concerned a consulting services agreement between the parties.  Ms. Terjanian successfully presented her case that, under the agreement, our client was engaged to provide consulting services to the retailer and, after reaping the benefits of those services for almost a year, the retailer suddenly terminated the relationship in violation and in breach of the express terms of the agreement.

Nicholas Marotta obtains defense verdict on behalf of ARFD client-hospital in Kings County Supreme Court.

Trial partner, Nicholas Marotta, supported by his trial team, partner, David Saffra, associate, Nadia Ali, and law clerk, Veronica Mishkind, achieved a defense verdict in Kings County. The medical malpractice case involved claims of an alleged failure to admit the 25-year-old plaintiff’s decedent to the hospital after she presented to the Emergency Department with flu-like symptoms. The plaintiff’s decedent subsequently re-presented to the Emergency Department the following day with progressive acute bronchopneumonia complicating H1N1 influenza, which resulted in her death at the hospital the following day. Aaronson Rappaport client is granted summary judgment dismissal in Kings County Supreme Court.

Aaronson Rappaport associate, Daniel Milstein, and partner, Sam Shapiro, were recently granted summary judgment on behalf of their client, an internal medicine physician, in a wrongful death matter concerning an alleged delay in diagnosing a dislodged gastrostomy tube leading to respiratory distress, peritonitis, and the plaintiff-decedent’s demise. In granting the motion, the Court agreed that the internist-client comported with the appropriate standards of care when he timely called for the appropriate specialist consult and sent the patient to the Emergency Room after his condition deteriorated. Additionally, the Court agreed that the internist-client did not assume any duty regarding the reinsertion
