The case was venued in New York County.  Plaintiff alleged that our client performed an incorrect cervical spinal decompression surgery. Alison Deaner, through preparation and well-written summary judgment papers, convinced a plaintiff to drop a lawsuit brought against her clients – no easy feat.  The preparation for such a motion came during precise questioning of the plaintiff at deposition, which eradicated a certain record-keeping issue in the case.  The record-keeping issue resolved, Alison thereafter moved to dismiss the case on the medicine, crafting arguments that convinced plaintiff’s counsel to voluntarily discontinue the case without opposition.  It was Alison’s preparation and obtaining multiple important  admissions she obtained at the plaintiff’s deposition, combined with excellent written advocacy during summary judgment proceedings, that compelled the plaintiff to discontinue

Another defense verdict for Jay Rappaport and ARFD client

Congratulations to Jay Rappaport and his litigation team for another successful defense of an ARFD client!  The case was tried in New York County and involved claims that ARFD’s client, an orthopedic surgeon, failed to properly diagnose and treat a subluxation of bones in the plaintiff’s foot, and negligently advised the plaintiff to weight bear on the subject foot, resulting in the development of arthritis and need for surgery.  Jay effectively established on cross-examination of the plaintiff and the plaintiff’s expert that a prior injury was so consequential that it would have led to arthritis regardless of the care rendered

Pre-trial Motion Results in Breast Surgeon’s Discontinuance from Kings County Wrongful Death Lawsuit

Larry Bloomstein and Robert Isabella successfully obtained discontinuance of a breast surgeon charged with failing to biopsy a breast with suspicious findings found on mammography.  The patient later died due to metastatic breast cancer.  The litigation team successfully argued  before a Kings County trial judge on the eve of jury selection that a key expert designated to testify against ARFD’s client should be precluded from doing so.  The court sided with ARFD and the claims against the breast surgeon were ultimately discontinued.

Two more successful summary judgment motion outcomes for ARFD clients

Lawrence W. Rosenblatt and his team were able to achieve dismissals on behalf of multiple ARFD clients in April and May in two  cases – in Queens and Kings Counties – as a result of summary judgment motions. The Queens matters involved issues surrounding the performance of emergent neurosurgical treatment by two neurosurgeons.  It was claimed that these defendants improperly utilized lysing agents during emergent surgical intervention of a patient who stroked during an aneurysm surgery.  The plaintiff further alleged that, as a result, the patient suffered a brain bleed, became neurologically compromised and untimely expired years later from this condition.
