ARFD is proud to announce that Partner, Daniel Nessim, and Associate, Robert Isabella, secured a defense verdict in Westchester County Supreme Court.
A verdict in favor of the defense was obtained after a three-week trial. The then 21-year-old female Plaintiff had suffered a tri-malleolar fracture after a fall. The Defendant doctor performed an open reduction and internal fixation surgery. The Plaintiff subsequently developed a post-operative infection, including drainage from the wound and an abscess. The defendant’s orthopedic surgeon saw her during four post-operative visits and treated her with oral antibiotics.
Plaintiff contended that blood testing for infection should have been done, a wound culture, an MRI, referral to an infectious disease specialist, and IV antibiotics should have been administered. The plaintiff was treated subsequently by non-party surgeons by having all hardware removed, a washout surgery, as well as a prolonged course of IV antibiotics. Plaintiff claimed that as a result, her ankle was unstable, she had daily pain, and could no longer run.
